Lugar: “I Meet the Residency Requirements”

U.S. Senator Richard Lugar today says despite charges to the contrary, he is a resident of Indiana and meets all the requirements to be on the ballot for the May 8 primary.

Lugar made his comments to the media shortly before speaking to hundreds of Republicans at the 22nd Annual Lugar in Excellence in Public Service Luncheon.

Lugar said he meets the residency requirements to be on the ballot, although he and his wife keep a home in Virginia. He also reiterated that he made sure he would be able to be on the ballot legally before he and his wife purchased the home.

    In the second part of Sen. Lugar’s interview, a question was raised by an reporter about giving truthes on your drivers license violates the Patriot Act, Lugar stated some to the effect he didn’t know the particulars of the Patriot Act and wouldn’t answer the question!

An Indiana lawmaker won’t support a resolution celebrating the 100th anniversary of the Girl Scouts because he believes it is a “radicalized organization” that supports abortion and promotes homosexuality. Rep. Bob Morris of Fort Wayne has sent a letter to fellow Indiana House Republicans explaining why he opposes the nonbinding resolution. The Journal Gazette reported Monday that Morris said he found online allegations that the Girl Scouts are a tactical arm of Planned Parenthood, encourage sex and allow transgender females to join. He also wrote that the fact that first lady Michelle Obama is honorary president should give lawmakers pause before they endorse the Girl Scouts. Spokeswoman Ashley Sharp of the Girl Scouts of Northern Indiana-Michiana says it’s aware of negative websites but says they haven’t affected the group.

    Really, Ramon?  Lugar last lived in Indiana in 1977.  The Constitution says a person has to be an “inhabitant” of the state.  The U.S. Supreme Court has said states can’t expand the qualifications seciton of the Constitution.  Lugar admits he doesn’t live in Indiana and uses a house he sold in 1977 as his “residence.”  And you think Mourdock is being unreasonable in questioning whether a person who hasn’t lives in Indiana for 30 plus years should serve as Senator of Indiana?  I can guarantee the
    Ds are going to raise the same issue and may well not seat Lugar if he’s elected.

    I gotta weigh in….

    As a former Federal Worker (GI) for two decades, here’s how it goes for those in military service, (and I lived in MANY states as well as over seas).

    When I entered, my home of record at the moment I took the Oath of Enlistment stayed the same unless I took ‘positive steps’ to change that home of record. 

    The ‘BIG 3′ Positive Steps were;
    1) Registering to vote in that ‘new’ state.
    2) Changing my State Income Tax location so as not to have to pay taxes in my home of record.
    3) Getting a new drivers license in that new state.

    Now, there were things I could do, like own a home in the state I was based, or register a car there also, all while keeping my original home of record.  I did not have to own property in  my home of record. All I needed was a mailing address.  Most GI’s used the address of a family member, or a PO Box.  Simple as that. 

    Now, that was a whole different ball game for my civilian spouse.  Even though she was a veteran herself, she had to become a resident of what ever state we resided in, as she was not in Federal Service.

    When we were in Michigan, she had a drivers license, paid taxes, registered to vote and census counts in Michigan.  Same for South Dakota, same for Alaska, same for Louisiana.  Usually this is required to be done in 30 – 90 days, depending on the State’s requirements.  It was a hassle, especially when we went outside of the Continental US…. that’s when her residency reverted to my home of record.

    Millions of GI’s have gone thru this residency thing since the AVF started in the mid 70′s, so I fail to see what the debate is about as far as Sen. Lugar himself.

    Now, about his non-elected, civilian spouse….. unless there is ‘hard paper’ showing an exemption to elected officials’ spouses, she is NOT and Indiana resident. (At least by the rules/laws that govern millions of other federal workers).

    Scooter, regarding Lugar, the  requirement that a Senator be an inhabitant of the state he represents is governed by Article I of the U.S. Constitution.  There are Supreme Court decisions saying that neither state law nor a law passed by Congress can change the qualifications provision of the Constitution.  With regard to meeting the qualifications provision of Article I, Lugar’s situation is not like being in the military as there is no federal constitutional provision regarding the military. 

    The qualifications provision is a separate issue from voting. As I’ve said before as to Lugar, I am aware of no exception in the voter fraud/perjury statutes that allow you to sign documents under oath saying you live at a house you sold 35 years ago,  when you know you don’t. 

    You’re of course dead right about the spouse when it comes to voting.  But in fairness to the Lugars, he’s not the only one doing this sort of thing.  Look at Evan Bayh for example.  Still Lugar takes it to a new level using someone else’s house he sold 35 years ago.

    In the land of sound bites at last the yipping have found an issue they think they can understand.   The real issue is this: if and when the Senate goes Republican the Senior Republicans who will be, by seniority, very powerful, are going to be Hatch and Lugar.  Both came in 1982 and both have accumulated powerful enemies which enemies are our enemies, too.  Lugar knows how to deal with them and to them he is a mortal threat.  Thus, the various cat’s paws as Hoosiers are used.

    I don’t know, but my stomach turns every time one of these crony’s steps forward, I’ve felt this way way back in the 60′s when these old fuddy duddy’s were running the show in DC, still feel this way, every one of these fat cat’s become millionaires at our expense, give the wink and the nod for this or that, throw people under the bus, but you better not poke that bear, or you will see the bears rath!

    As for Sen. Lugar: there’s a huge difference in his case and most others.  He actually SOLD his voting-residence for a profit over two decades ago.  

    Simple solution: he asks the new owner if he can use the home as his voting address, pays a small lease fee, and there you have it.

    He didn’t do that.

    Big mistake.  Arrogant.  Forgetful.  All of the above.

    And it would be a crying shame for Indiana, if a dope like Mourdock was the beneficiary of public anger over this issue.

    But….that’s politics.

    At the time, the common DC joke was: Indiana’s two senators are Bayh and Bought.  

    If Mourdock wins the new mantra could be: our two senators are Tweedle Dum and Tweedle Dumber.
