It appears two local Democratic elected officials are running afoul of the law.

First Indianapolis Metropolitan Police are investigating City-County Councilor Doris Minton-McNeil over a possible hit and run incident three days ago.  Police were called Saturday to the 2000 block of Medford because a woman had called 9-1-1 saying McNeil was driving a green Trailblazer and nearly ran over the woman’s daughter and her seven-week old granddaughter, had alcohol in the car and yelled obscenities at the woman.

Police went to McNeil’s home where they say she would not answer at first and McNeil’s sister had to convince her to open the door.  Officers say McNeil smelled of alcohol and her speech was slurred.   McNeil said she had been home all day, however officers noted her engine was warm and there were fresh skid marks in the street.  While talking with McNeil officers noticed the front of her vehicle showed some damage consistent with a hit run.   Officers are investigating  whether McNeil might have been involved with an accident at IPS’ parking lot.

McNeil was recently acquitted of charges of public intoxication and disorderly conduct.

If that wasn’t enough, a Lawrence Township Board member is having her township pay garnished for failing to pay property taxes. Emmajean Hines failed to pay back taxes and now is having her township paycheck garnished.  In the past Hines has has voted to raise the pay of the township board,  and questioned why board members did not have health insurance.

    Somebody needs to explain to Doris that the E85 thing refers to 15%alcohol in the gastank and doesn't mean the driver maintains a .15 BAC.

    The Councilor Minton-McNeil matter seems to me to be an accusation that a public official committed a crime without evidence. I seem to recall a couple days ago a charge made against me, namely that I accused the Sheriff of committing a crime without evidence. Of course I did no such thing. Rather I mentioned that the Sheriff's inmate telephone contract had a kickback provision, a common term that everyone who has ever dabbled in contract law understands is often found in privatization contracts and knows does not equal a crime. What I find interesting is that here there is no doubt – this is without question an accusation that a public official committed a crime…without evidence. Apparently what is good for the goose, is not necessarily good for the gander.

    As far as the property tax matter, property taxes are liens against your property. If you don't pay your property taxes, the property can get sold. You have a year to redeem the property after it has been sold. I've never heard of property taxes being collected through a garnishment proceeding, but I guess it is possible.

    Contradictions in terms are legal quandries (sp?), the purpose of law being clarity. Where in the law is the notion of an “unspecified lien,” commonly practiced or provided for?

    Forgive me, Paul, for jumping to conclusions. You are correct that Ms. McNeil has not been found guilty, yet alone even charged with a crime(in this case). Then again, I thought Michael Jackson was a pedophile.
    This is just another addition to this woman's resume that qualifies her to be Democrat candidate for Mayor. Go, Doris! Go, Doris!

    Dave, I read your question three times, and I still don't get it. Property taxes are a lien. Title companies treat unpaid property taxes as a lien not yet collected, because Indiana's arcane property tax system is one year behind. This commonly-accepted practice has been upheld in multiple trial courts and at least one appeal.

    I agree with Paul that the accusations regarding the councilwoman–while compelling–do not make a case—yet. But this blog is an ideal place to air the truth, which I've come to expect form Abdul. And if the tidbits posted here are even remotely true, the councilwoman should be charged, and should resign.

    Time will tell.

    See, Paul, I got through that without calling you out for mis-using the kickback word again or pointing out that regardless how often you say it, kickbacks are not commonly-accepted business practice. I've got Friday restraint three days early. Weekends rock.

    TA: Liens by nature are… specific. You'll never meet a lawyer who has filed anything other than a very, specific lien. “Unspecified liens” are a contradiction in terms / practice.

    I've seen a copy of the wage levy notice issued by Sheriff Frank Anderson's office. The Department of Revenue is the taxing agency seeking collection of $351.01 in unpaid taxes from Hines. The Lawrence Township Trustee's office was served with the notice of the wage levey notice on May 7, 2009.

    It time for Doris to go. She is an embarassment to all of the organizations she is affiliated with. As a side note she was a Wayne Township Board member, filling David Baird's seat when he was elected trustee in 2006, before she went on the council. Does she still work for IPS? Great role model for kids…the ones she doesn't run over.
