White Guilty of Voter Fraud

A Hamilton County jury has found Indiana Secretary of State Charlie White guilty of voter fraud.  Indiana Governor Mitch Daniels has appointed long time Secretary of State employee Jerry Bonnet to the position temporarily, he has currently been acting as Chief Deputy.

According to the Indianapolis Star, White was found guilty on six of the 7 felonies he was charged with.  However, since the charges can be reduced to misdemeanors, White could still keep his job.

The decision came at 2 a.m. after 12 hours of deliberations.  White’s attorney, Carl Brizzi, did not present a defense.  Special prosecutor DJ Sigler laid out a very detailed in closing arguments, including using White’s own cell phone records against him.   The Attorney General’s Office did not represent White in the matter, but says it may assist in an appeal as provided by statute.

White was accused of voting from his ex-wife’s address in the May 2010 primary.  He was acquitted on the more serious charge of fraud on on financial institution.  White was not taken into custody and is appealing.

    Nope.  Although he has some ‘splainin to do, Sen. Lugar goes to Washington for us.  There is much more leeway for folks who have to establish a second home six states away. The judicial precedent is pretty clear.  Unless he lied about the residence.

    And there’s the added drama of a complete nutjob trying to take Lugar out in the Republican primary.

    I’m torn–I like Sen. Lugar’s long tenure, foreign policy gravitas and brains.  But I love a good Republican primary fight.  They happen so seldom.

    Evan Bayh has the explaining to do.  Now that he is no longer in service to the government [only in service to those who are willing to pay him millions]  he no longer qualifies to be a legal voting resident of Indiana…..why is there no  outcry about his residency??

    The beauty of being a Dem is that you never have to explain, and the beauty of being a Repub is that the explanation is always obvious.

    How could the AG help out Charlie on an appeal?  Isn’t the AG supposed to represent the State (prosecution) on any criminal appeals?  There would seem to be an inherent conflict of interest.

    Frankly the current is unconstitutional.  Think if we disenfranchised blacks using a similar tactic.  This disenfranchises over 90,000 republican voters in favor of the guy who lost!  The Sec. of State office is a political office where the candidate is selected by the party via convention rather than by the people in a primary.  Thus one votes for the party, not the man.  And the Sec. of State vote is used to determine all sorts of political position such as who is at the top of the ballot or the inspectors at the polling place.

    Too many lawyers are gameplayers rather than sportsmen (think of the current ISHAA ads about sportsmanship vs. gamesmanship).  And the dems seem to be more into playing games rather than being honorable.

    Now, any suggestions on a lawyer who might help me write a friend of the court brief, or even bring a lawsuit, over the constitutionality of the current laws governing the replacement for the Sec. of State?

    Those three words define why our Constitution & Bill of Rights are sinking in the outhouse pit.

    Those in the legal profession ARE the source of problems… no matter if it’s a tinker toy or purchasing real property, that profession has mucked up everything it touches.

    There is no disenfranchisement.   If those 90,000 people (not necessarily Republican voters as you claim – I’m sure some Independents, Libertarians and Democrats voted for him as well) had written in “Mickey Mouse” would you say that they were disenfranchised for voting for a non-existent candidate?  Of course not.  But that is exactly what Charlie White was – a non-existent candidate (because he was not legally registered to vote).

    I think that statement is much more applicable to Charlie White (for playing games with his residency to maintain his employment with Fishers) and Mitch Daniels (for playing games by encouraging White to resign months ago so Daniels could appoint a replacement rather than wait for the court that would inevitably rule against White thereby installing Osili as SOS).
