Charges Filed

Reckless homicide and several other felonies have been filed against IMPD officer David Bisard for the death of one motorist and the injuries of two others.  You can read the charges below.  There are several felony drunken driving charges.  A warrant has been issued for his arrest.

    What would be the point of arresting the man? He isn't going anywhere. And, what impairment? Are you not assuming impairment? Let's suppose that Sweden says you are impaired with a bac of .01 does that mean you are impaired? There is little science to Sweden's .01 in my view.
    At any rate, the consequence of being in custody seems to be that a $10,000 bail was posted, period.

    The point would be that LEOs don't get special treatment when they are allegedly breaking the law. If I ram my car into some motorcyclists and end up killing one, putting another in a coma, and severely injuring a third, I don't get a spokesperson who insinuates it was pretty much their fault. I'd be arrested and tested for BAC right away.

    And his danger would be getting drunk and getting into the driver's seat.

    Doesn't appear to me that any special treatment has been afforded here in this case. What, specifically are you pointing out as special treatment? The newspaper reports witnesses as saying that with siren and lights on the police car was swerving between traffic lanes-presumably to avoid motorists who were NOT getting out of the way.
    Tell us why the cyclists were in the left hand turn lane given the situation and why that would not be contributory negligence.

    You're not supposed to move out of a turn lane, even if an emergency vehicle with lights on is coming. It's not realistic in any type of transportation, truck, car, or bike.

    The special treatment is if I crash into a bunch of people, I'll get my BAC tested right away and arrested. This officer was able to go two hours without getting BAC tested, and was not arrested until the prosecutor officially filed charges.

    Apparently, all vehicles were moving to the West on 56th. So, the police car was coming from behind them with lights flashing, siren on, at a high rate of speed. I'm guessing that both traffic lanes were full of one to several cars stopped by a useless stop light and that the cyclists were in the turn lane with the idea of turning to the South when the light would change so as to allow traffic to flow.
    In addition, the officers responding to the accident had pressing duties attending to the scene and the injured.

    The idea there would be “evidence” at the scene is laughable. Folks, there are functioning alcoholics in this world. This is exactly why the statue was changed to require a test for intoxication at the scene of a serious crash and/or fatality crash. Train operators are also forced to submit to a test.

    The FOP president said there was a doctor and nurse in the room during the blood draw. Ask them if they smelled an odor that is “commonly associated with an alcoholic beverage?” The one thing I don't like here is that I heard he only was in the APC for a few hours. That is BS. He should have been processed the same as everyone else, no line jumping. The bail should have been the same as anyone else with similar charges.
