IMPD Releases Findings In Police Brutality Case

Indianapolis  Metropolitan Police Officials are recommending one officer be fired and two be disciplined for use of excessive force against a local teen.

Sources say Public Safety Director Frank Straub will recommend this morning that Officer Jerry Piland be let go and officers Stacy Latinga and David Carney be reprimanded.  A fourth officer, Oliver Clouthier, was not disciplined and IMPD sources say he was crucial to resolving the matter.

The Officers had been on desk duty since the investigation began last month.  Officers were called to the scene after getting a call that 15-year old Brandon Johnson’s young brother was breaking into a home on Fisher Creek Drive on the east side.

When officers arrived and arrested the younger brother, Brandon reportedly approached police and an altercation ensued.  Police say Brandon did resist arrest and reasonable force was used to subdue him, however those same sources say Piland went beyond what was reasonable and that led to the recommendation that he be discharged.

The Marion County Prosecutor’s Office declined to charge Brandon Johnson with disorderly conduct.

    Awww….desk duty…such terrible punishment! Give me a break! And by discipline do you mean a shrink and 3 days off without pay? Probably even less punishment than that. These police officers are OUT OF CONTROL! They think none of the rules apply to them and I blame the head of this city and state! Crack down on these fools and do something about it. They never follow the rules of the road while in the car. Speeding, parking wherever they want, lack of turn signals and sometimes using the lights and sirens inappropriately! STOP ALREADY!

    Next time you get in trouble, call your local gangsta instead of 911, see what happens. You obvisouly know nothing about the IMPD, what they do or how they do it. I suggest you be more concernd about making sure that your Mobile home does not get blown away in a big wind.

    I am stunned. Still, this took too long.

    But, as stated before, I have a lot of faith in the new chief. And one fact folks seem to overlook:

    The prosecutor, as bad as he is, is a lawyer. He declined to press charges, I suspect, because he knew the LEOs' actions were at the very least, sufficiently aggregious to thwart any serious jury/judge in prosecuting Mr. Johnson. I don't think Mr. Brizzi is a stupid lawyer, just a stupid prosecutor (most of the time). Looks like he nailed this case ten days ago. From a prosecutorial standpoint, at least. I wonder: if the LEO's actions were this bad, can he be criminally charged?

    For what it's worth, I've watched two arrests in my life, both in the last year. Each situation involved two or more alleged perps, and multiple police officers. Still, it was difficult for the police to subdue the perps, and it was highly-emotional. I wouldn't second-guess most LEOs for the life of me. They have to make snap decisions.

    Let's hope that if this dismissal and discipline hold, all parties involved learn and go on, without grudges. That would be win-win.

    I doubt it'll happen, but a guy can hope, huh?

    It's good to seen the aftermath addressed. Even an internal investigation recognizes some officers were out-of-bounds and punishment dispensed.

    As far as what caused the whole episode, anybody working on the parenting and behavior of the thirteen year-old breaking into a residence in broad daylight?

    Over and over, issue after issue, one level of goverment and society after another- we get all stirred up about the results, but dare not tackle the upstream problem.

    Police beating up kids isn't right, but neither are kids breaking into houses in the middle of the day.

    Don't worry about the victim. I am quite sure that the inevitable future settlement with the (self-insured) City will assuage any pain he's suffered. More tax dollars down the drain, though.

    Brizzi should quit rolling over and playing politics and charge the two thugs with the crimes they committed. illegal entry and resisting arrest.

    My position is still pretty much the same. Brandon Johnson is responsible for his injuries up until Jerry Piland crossed the line. Had he complied with the Officer's lawful orders, none of this would have happened. Maybe his mother should have done a better job of raising him.

    Abdul I am sickened that IMPD would recommend the firing of one of the officers involved. What are the police supposed to do when they respond to a call and there is an individual that interferes with their official work, in particularly interfering with in arrest? These officers put their lives on the line every single day and given the recent events of the Fishburn incident and the IPD officer that was shot and killed a couple years ago, why wouldn't these officers use some type of force to subdue an individual who is interfering with them and potentially inciting further violence against the officers at such a close proximity. These officers do not know why type of weapons these individuals might be carrying and it is a survival tactic to respond the way they did.

    Now was the force excessive? Maybe, maybe not. Judging by Johnson's face, we could say perhaps. But given that there was an altercation and Johnson inevitably went to the ground, probably in the street, it is no wonder he ended up with the injuries he did if he was resisting officers while he was face down on the street. I believe all of this a slap to the police officers who put their lives on the line to keep us safe everyday. Now they will have to think twice before using force in order to protect themselves and make a lawful arrest. It is just ludicrous.

    You forgot to mention the part where the kid was lying face down, handcuffed, IMO he was in custody. Now if he wasn't handcuffed etc, then I would say a good butt kickin' would probably do.

    I'm sure this will be a 'teaching moment' for young Brandon and he'll now go on to be a fine, upstanding citizen.

    Does anyone else think that this decision was made to appease the 'concerned clergy'? Would there be the outcry if Brandon Johnson were white? If he were, would these concerned men of faith even give a damn? Or is it just about demonizing the police?

    I listened to the statements by mom, the lawyer, and the community leader. Of course their version of events is suspect, as there is no video of the incident that I know of. Anyways, they claimed (from what I could hear, the static on 1310 was bad during the live feed) that one officer actually crossed the street to deal with Brandon. They said that Brandon was told to stay back, and that is exactly what he did. While he might have kept running his mouth, unless he is stating threats, basic questions of “Why are you locking up my brother?” shouldn't amount to interfering if one is as far away as they are claiming.

    Eventually all cops are going to be wearing cameras. That will provide a lot of information in cases such as this. Given that IMPD said the one officer shouldn't have arrested Brandon, I would say the statements by Brandon's entourage have more weight now than they did before.

    This thing is far from over. The FOP have declared war on the firing. Brandon's entourage have made demands for other things to happen. All we can do is wait and see what happens.

    What will the self appointed old school leadership say now?

    Will they offer outrage and focus upon demonizing law enforcement and promoting no community cooperation (No snitch campaign).

    Will they call for a higher level of conduct and personal responsibility by members of the community?

    Will they offer a statement in regards to the unacceptable levels of crime and misbehavior within the community? (Maybe even speak to Brandon and his brothers behavior?)

    Will they try to raise the level of community outrage during the peak crime season, rally the community at the Expo, and follow it up with the standard financial shakedown?

    If this officer 'crossed the line”, and a supervisor/Sergeant was on the scene, Why wasnt the Sgt recommended for termination or demotion? Otherwise the incident happened with IMPD official managements approval.

    Will the old school leadership and media ask Brandon, his brother, and their friends who was breaking into neighbors homes and stealing?

    Seems if they weren't involved, they would know who was?

    Perhaps everyone has forgotten the neighbors who called the police and were victims of burglary and break ins.

    Lionel Rush, a pastor and community leader who spoke on behalf of the family, listed items for police to address. A handout to the press titled “A Community Response to the Actions and the Non-Actions of the Indianapolis Police Department Pertaining to Brandon Johnson” outlined the requests. One of the most significant ones called for a federal monitor to be appointed to watch over the police, due to the mistrust of the police after a number of racially motivated cases.

    With the excessive response of the police duly noted and not condoned, where's Pastor Rush's “Community Response” hand-out for how we should cope with 13 year-olds breaking into homes? Would his “Community Response” note the need for parenting, preferrable with a Mom and a Dad for teen-age boys, or help from extended family if needed? Is there anything his parish would like to offer to help familes keep kids stay on the straight and narrow, and not being involved in situations like this one?

    It would be nice, Nick, if the community leadership would collectively do as you say.

    But why do you want them to do it now? Why this time and place?

    Our correct response to the incident should be: one police officer misbehaved badly, two others got reprimands. We expect them to behave like 99.99% of their fellow LEOs do.

    Today, that alone should be the story.

    That, and our sincere thanks to that 99.99% which doesn't behave in a manner that calls their actions into question.

    There is a blatant undertone to some of these comments that is not pleasant or helpful.

    I respectfully disagree. I believe this gets repeated over and over, all across America until we address BOTH sides of the story. I'm not excusing the behavior of law enforcement, nor ignoring the incident brought them out there in the first place

    I hope they are inspiring and use this opportunity as a positive teaching experience that everyone can support. (i.e Obama message of stating the obvious and calling out bad actors)
