Editor’s Note:  If you haven’t read Sunday’s post, Bar Wars, you may want to do that first before going through this one.

As I wrote Sunday, there is legislation pending in the Indiana General Assembly that could potentially give a virtual monopoly on alcohol distribution to one Indiana company, thus leading to potential higher prices and a serious court challenge on Constitutional grounds.

The company, National Wine and Spirits, sent an e-mail out to its customers asking them to support HB 1191, which would force an alcohol wholesaler who gets a contract from a supplier to reimburse the previous holder of that contract for any lost business.  I obtained a copy of the e-mail.  Here is it…

Over the past 37 years, National Wine & Spirits has earned successes that I could never have imagined – all at the hands of a terrific and committed team.  Some of you have been with us from the very beginning, others have just recently joined.  All of you are important members of the National family.
 
As you are probably aware, Southern Wine & Spirits is actively trying to enter the Indiana market, steal our suppliers, and put us out of business.  We are doing everything possible to fight them off.   Currently, we are driving legislation (Senate Bill #244 & House Bill #1191) that will help level the playing field in wine & spirits wholesaling, making it much more difficult for Southern to lure our suppliers away.
 
To help in this effort, we are asking you to sign and provide some supporting comments that a Representative or Senator might be interested in knowing through an online petition http://www.PetitionOnline.com/244y1191/petition.html.  
 
We hope everyone will “click” their support, and pass on the link to friends, family, and customers.  We will use this (the votes and the comments) with the legislature at different times during the session – starting as soon as next week, so please take a moment to rally for the cause, sign the petition and spread the word.  Names of those who sign on will not be made public.
 
Nothing is more important to us than the well-being of our people.  We must show the state legislature that Indiana citizens want to keep this business headquartered and continuing to serve Indiana like no other.

As I mentioned in my previous post, it’s one thing if an alcohol supplier and retalier put a provision in a contract that if it’s terminated, one party must reimburse the other.  It’s another thing to make that a government mandate by etching that provision into state law.

    This is the first time I've seen one of those on line petitions with the signatures blocked from public view.

    Why would National Wine and Spirits hide who supports their monopoly on Indiana liquor sales?

    The first thing that comes to my mind is they don't want bloggers poking around.

    I think I'll contact my legislator and ask him to ignore SB 244 and HB 1191.

    Shades of Beer Baron! Unfortunately, folks get used to governments deforming markets and driving up costs. For instance, what is behind state owned liquor stores in Pennsylvania and Washingon States? The same thing that is behind a government role in Indiana, that is, Rockerfeller Foundation studies posing as public policy documents. When a gallon of beer can be brewed these days for a nickel or a dime per gallon (maybe a quarter given inflation) one begins to see why beer costs so much. Governments. Were the goal to serve citizens with rock bottom prices of high quality goods then in alcohol as in education, the State would not have a role and the market would deliver. So, the State has other goals, one of which is to line the pockets of politicians with political contributions as well as votes.
    Ending monopoly practices is generally good for people as the fight for citizens getting decent wine and decent prices direct from suppliers of same demonstrates. Screw National and their ilk. If the Legislature permitted it I could get my Gentleman Jack directly from Jack without passing go, without paying off parasites, and without indirectly funding legislators.

    Pascal, Jack cannot sell it directly to you for a reason. It alters your mind when consumed improperly, this licensing is involved. Since the dawn of time.

    And it's clear you don't really udnerstand the Beer Baron fights of the 70s. Read up.

    That is no reason at all, it is a pretense. Our legislature already allows me to purchase wine from Bloomington, IN directly. Read up in your Federal Code, you are still allowed to make your own beer, wine and whiskey….tax free. Since the dawn of your time your mind has worked improperly and without license. Governments horn in when you try to sell your products with all sorts of other reasons. Didn't your schooling ever include the Whiskey Rebellion? Or, were you shortchanged by government “instruction”. I can also get wine via my Wall Street Journal, or from California wineries thru the mail. I don't need 150 fools with their hands in my pockets charging extra for nothing.

    Re-imburse the previous contract holder? That's laughable. Should be a no-brainer in federal court as it interferes with the right of contract, if not the commerce clause also.

    Saw him tonight at the IU College Republican. Literally he told us “You are either free or a slave.” He also bragged about how he has the freedom to buy “whatever size microwave he wants” and “I can buy my wife a plane ticket”. He made no logical points or said anything about his positions, he just made mention to the fact that “Barack Hussein Obama” is ruining America.

    I would definitely disagree with this petition. It would just create monopoly and will lead to higher prices for alcoholic drinks.
