AM I MISSING SOMETHING?

With all the news on property taxes at the legislature and the upcoming transfer of power from Frank Anderson to Greg Ballard regarding IMPD as well as all the other things going on around town and trying to balance a very active personal life, I’ve been pretty busy as of late.  So I have to ask you guys, is there something going on in your neck of the woods that’s worth writing about, but I might have missed?  Feel free to post it here or shoot me a note by clicking our “submit a story” link.  Thanks.

    I just watched a documentary called America: Freedom to Fascism. The thing that drew me in to watch this was the notion that we shouldn’t be paying federal income tax. That we do not have a law that requires us to do so. King Abdul, please watch this show and let us hear your thoughts on the matter. You’re a smart legal guy and I’m sure you will be able to tell what is fact from fiction. Watch the whole show though.

    I have read on various blogs that the new Mayor is possibly naming some questionable characters to his administration, or extended administration. One is with the Airport Authority leadership role. Surly not. Money cannot buy character and we now know about his character from his high level Washington experience. Self control, especially in powerful positions is the least we can expect. I do worry about the statement being made by Ballard regarding his personal character as he possibly surrounds himself with such folks. At the end of the day, we are who we associate with. My goodness. The named candidate may have many qualifications, but he should forfeit future public service given the disregard he has shown for the trust placed in him in the past. And we wonder why the lowest of street thugs feel no accountability for their actions. Leaders must lead through character.

    Check out the following story from last summer in Shreveport, Louisiana. A man was acquitted on all charges for failing to file federal income tax returns because the court could find no law compelling him to do so.

    “Cryer says he stopped filing returns more than 10 years ago after he investigated claims that income tax was a sham. He contends the law doesn’t actually tax personal earning.”
    I’ve researched indepth into both sides of the income tax debate. It gets very hairy and arguments can be quite convincing on both sides of the coin. I finally decided to cut to the chase and search through the tax code for everything that was possibly relevant to requiring individuals to pay the tax. As I did so, I kept track of how terminology such as “individual” and “income” are defined within the code. When I apply the definitions of these words that are specifically spelled out within the code, I can find no evidence that wages or earnings from your work (ie: not profit from sales) are subject to the tax.
    That being said, I’ve aslo discovered that for every year that you file or maintain a pre-existing W-4, you have entered into a contract that, by signing, obligates you to pay the tax.
    Therefore, for example, I’m obligated. More-so out of my fear of going to jail rather than belief that the system is legal.
    I haven’t watched F2F yet, but I’m well aware of it. I think I might check it out and see what Russo had to say.

    Thank you Shorebreak for pointing me to the article. They stated the following, “The Supreme Court has ruled that the government cannot impose an income tax on anything but the profits and gains. When you work for someone you give your service and labor in exchange for money, so everything you make is not profit or gain. You put something into it.” Does this mean that I do not have to have federal income tax taken from my 9-5 40 hr a week job?

    why is it republicans are against raising the mimimun wage which will cause lower income workers to receive the unearned income tax credit. this takes away money from the middle class forcing them into higher taxes…wouldn’t it make more sense to lower business tax, raise the mimimun wage and do away with the unearned tax credit?

    It’s not the Republicans that are against raising the wage it’s their donors. I’m sure you understand what will happen if the minimum wage is increased to a “living wage” (somewhere between $12-16 per hour). Even though it increases the buying power for the individuals use to working for $6.50 (soon to be $7.50) and could boost our economy but it will also cause the cost of products manufacured or produced i.e., fast food, in the US to shoot through the roof. Causing job loss and inflation to rise even farther which isn’t good. It isn’t that the Republicans don’t want people to starve or what have you, it’s more of the notion that if people want to make more they have to work for it. Like finishing High School, going to college and taking pride in the achievements, only to be rewarded with higher paying employment. Sure people make poor choices in their lives that will effect their future but they shouldn’t be awarded for it and surely the country suffering for their mistakes isn’t the way it should be. They should be happy with a minimum wage anyway because most countries don’t have one.

    I’ve also been doing some digging on Indiana Dem leadership (superdelegates, etc) and you may be surprised to see how that system “works” against change (in other words, for Hilary and against Obama.)

    Sen. Pat Miller, who with her various, theocracy-based legislation over the years has made me not a fan of her or the (R)’s was surprisingly shot-down over a bill that would make the transition from legislature to lobbyist more difficult.

    Yes Abul you are letting the ball drop. How many stories in just the last few days have we read story after story about convicted felons out committing crimes again. Why are these people let out time after time. Why are judges and courts not being held accountable for letting these people out early? If we want the crime rate to drop in this city the we must demand changes. Just like todays story of the drunk driver who killed was let out Fri. only to re-offend.

    Cryer’s tax case proves only that the government couldn’t establish that he knew he had to file taxes, which is an element of the crime of willful failure to file. The court rejected as “without merit” his argument in his motion to dismiss that that he had no taxable income as a matter of law.

    Your link fails to define “income” per Title 26. Also, the list provided in the link does not include wages or salaries.

    I’m not arguing for or against. I’m simply stating that the evidence you’ve presented doesn’t hold any weight.

    I believe that we have to pay it. I’m just not convinced that it’s a legal tax.

    1. Crime rates in Bart Peterson’s worst year were still better than under his predecessor.

    2. The Sheriff has always had more territory in Marion county than the Mayor of Indianapolis, and in the 1970’s, he started having more people under his jurisdiction.

    3. Greg Ballard has already broken his campaign promise on appointing lobbyists to boards and commissions.

    4. Ballard has exactly the same number of press aides and deputy mayors as Peterson did.

    5. Ballard still has about 20-30 vital appointments to make in City Government.
