My sources tell me a class action suit could be filed this week that could throw a major monkey wrench into Mayor Bart Peterson’s plan to consolidate the IPD and the Sheriff’s Department. They also say the class action suit will center around social security. Several officers will file suit to stop the city letting sheriff’s deputies opt out of Social Security, saying the withdrawl would lead to pay disparities between officers. The city recently received word from the federal government they did not have to force IPD and new officers into social security, saving $4 million.

What is actually happening is that the Federal Government has told the city/county that former IPD officers can remain outside of social security including all new hires to IMPD. The Social Security Administration went on to say that the deputies could vote as a block to keep or relinquish social security.
The problem is that the administration and/or sheriff are automatically removing the deputies from social security prior to them even voting. General Ordinance 110 is the ordinance that governs and spells out the entire merger and establishes the new merit law concerning IMPD. This law clearly states that no officer or deputy will lose pay or benefits as a result of the merger.
Automatically removing the deputies from social security, prior to an affirmative vote to that effect is clearly a violation of the ordinance and is another example of the administration’s unwillingness to even follow their own rules that they wrote.
On its face, it is a violation of the law and I am certain that it will be rightly addressed in the form of a class action law suit.
The IMPD Administration’s shameless display of bravado regarding this and other matters does little to hide their own ineptitude for those of us well-versed on such matters.

FYI, a certain deputy coroner told me Ballew and Ackles are threatening their staff about posting comments here or talking to anyone about the mess they created at MCCO. So, add intimidation to theft, ghost employment, altering of official records, and the creation of a racist, hostile work environment. Let’s hope someone can stop this before it goes any further.
