The bigger issue to me is (potential) DUI.  By Mr. Gibson's own admission, he had much to drink, and when the entire incident ended, he drove himself home.

Having said that, a D.O. charge after-the-fact is a little wierd.  My guess is that both of them--the officer and Gibson--got mouthy.

Typically, in that scenario, it's GameSetMatch to the police officer.

BTW: the 7 little words: "You Have The Right To Remain Silent."   Sometimes those are cogent words of advice pre- and post-arrest.  I can't imagine Gibson shutting up anywhere, anytime.

Who was armed with a weapon, Gibson or the Sheriff's Deputy?  I ask because it's not against the law to express yourself to an officer of the law, the constitution protects even unflattering language.

Did he threaten the officer's life or the officer's job?

I would be interested in the interview.
